A word from the CEO

Welcome back everyone. I hope you were able to enjoy at least a bit of a break. I was lucky enough to go to Hawaii for a most excellent holiday—it is one of my favourite places on this planet, but in spite of its beauty and thriving tourism industry there was no council bin collection, no household recycling and terrible roads! Plus I read in the local paper that councils are now closing parks from 10pm to 6am in an effort to ensure there were no homeless using the parks overnight. In Hawaii, you see homelessness everywhere and it is very confronting against a backdrop of holiday indulgence. While we are always looking for ways to support our members to deliver even better outcomes for our communities, it is also important to look at all the things we do so well and this trip made me feel very fortunate to live where I do.

As your new councils settle in, I hope you are all feeling positivity among your teams, and our upcoming conference program will help you do just that! The theme is ‘Communicate to Captivate: Conversations in Local Government’ and the aim is to ensure we are framing the conversations we have with ourselves, our teams, our communities and government in a positive way. Don’t delay—register today—not only will this be a great day of learning spent with colleagues, but you will also be supporting all the work LG Professionals, SA does throughout the year, so please consider booking an extra table or bringing a friend.

In other news, we have made some exciting changes to the Professional Leaders Program, now called the Strategic Management Program, which has been condensed to three modules instead of four … with no exam! The program is co-delivered by UniSA and accredited towards an MBA. It focuses on operational, strategic and financial skills and past participants have seen immediate results back at work in terms of cost savings and efficiencies. More details below, but registrations are closing very soon—let us know if you need more time.

In closing, I would like to wish all nominees for our Leadership Excellence Awards good luck—you should all be proud of your projects and initiatives.

A Victoria local government council has been found by the Commonwealth Fair Work Commission to be a ‘constitutional corporation’ for the purposes of the (Federal) Fair Work Act 2009 (Cth) (FW Act). That status exposed it to a federal bullying claim.

No South Australian Local Government Council is a ‘national system employer’ pursuant to the FW Act. That status insulates South Australian Councils in many helpful ways. For example, the federal unfair dismissal jurisdiction and the National Employment Standards do not apply.

However, whether South Australian Councils are ‘constitutional corporations’ for FW Act purposes, remains a critical legal issue, possibly exposing South Australian Councils to potential litigation and disputes under the FW Act.

There is no ‘one size fits all test’ to determine whether your council is a constitutional corporation, however, an analysis of the councils trading activities must be taken into account ... click through to see more

Nominating for an award is a fantastic way to recognise your team's leadership, innovation, excellence and effort, and to reflect on the fantastic outcomes that you have achieved for council and community … it's also a great way to make connections and share across local government!

We can’t wait to read about all of the amazing projects happening in local government. There is no project too small!


18th Annual Leadership Excellence Gala Awards Dinner
Announcement of winners will take place at the 2019 Gala Awards Dinner, to be held on Friday 17 May at the Adelaide Convention Centre. Invitations will be sent in the post to all councils in February.
